Copyright Copyright for completed artworks remains with the artist
unless specifically assigned by separate agreement. All and any preliminary
works including sketches and photographs belong to the artist.
Price A price for an unframed piece
will be agreed between the artist and client prior to work starting on the
commission. This price may be subject to change if the client subsequently
changes their requirements or conditions.
Deposit and order
Work will not commence until
receipt of a signed order and payment of a non-refundable deposit comprising 50% of the agreed
unframed price plus artist's travel and accommodation expenses as appropriate.
Completion and payment of balance
The balance of the cost of the
painting plus any additional costs such as delivery and framing charges are payable upon completion. If
the piece is to be collected or delivered in person then payment can be made at
the time, otherwise full payment is required before despatch of the piece which
will not take place until payment has cleared.
Framing
If the piece is to be framed
then full payment is required before the framer is instructed.
Client
approval
The client will have the
opportunity to approve an image of the painting, either by mail or email, prior
to final payment.
Artwork purchased through
this website
Your right to cancel:
You can cancel your order within a period of seven working days, starting the
day after you receive the goods. Cancellation must be notified in writing
(letter or email) within this time. Goods should be returned in their
original condition within fourteen days of receipt. Artwork must be
returned in the same packaging or equivalent standard and (other than ACEO art
cards) by a guaranteed delivery service (courier or registered mail).
GLAZED WORKS MUST BE SENT BY COURIER.
Refunds:
Cancellation of order:
If you change your mind and cancel under the terms above, refunds will
be made in the same form as the original payment upon receipt of the returned
goods in good condition. Please note we do not pay the costs of returning
goods in these circumstances.
Faulty or damaged goods: Please notify
in writing within seven days of receipt. Please retain the original
packaging which will be required in the event of a claim against the carrier.
Photographic evidence may also be asked for. Goods will be exchanged or
refunded in the form of the original payment .
Delivery:
Framed artwork can be delivered only within the UK. Unframed work can be
delivered overseas.
We aim to despatch artwork within five working days of receipt of payment.
Late delivery will not constitute a breach of contract and neither Jane Duke nor Stoneflower Studio™ will be
responsible for any consequential loss.
When the studio is closed for holidays or any
other reason then a date when orders will be processed will be given on those
pages which offer instant purchase.
These terms do not affect consumers' statutory
rights.
